Emma Watsons UN Speech on Gender Equality

On Sep. 20,  2014, British actor and Goodwill Ambassador for U.N. Women Emma Watson  gave a smart, important, and moving speech about gender inequality and how to fight it. In doing so, she launched the HeForShe initiative, which aims to get men and boys to join the feminist fight for gender equality. In the speech, Watson made the important point that in order for gender equality to be achieved, harmful and destructive stereotypes of masculinity and behavioral expectations for boys and men have got to change. Biography Emma Watson is a British actress and model born in 1990, who is best known for her 10-year stint as Hermione Granger in the eight Harry Potter movies. Born in Paris, France to a pair of now-divorced British lawyers, she made a reported $15 million dollars for playing Granger in each of the last two Harry Potter films. Watson began taking acting classes at six years of age and was selected for the Harry Potter cast in 2001 at age nine. She attended the Dragon School at Oxford, and then the Headington private girls school. Eventually, she received a bachelors degree in English literature at Brown University in the United States. Watson has been actively involved in humanitarian causes for several years, working to promote fair trade and organic clothing, and as an ambassador for Camfed International, a movement to educate girls in rural Africa. Celebrity Feminism Watson is one of several women in the arts who have leveraged their high profile status to bring womens rights issues to the public eye. The list includes Jennifer Lawrence, Patricia Arquette, Rose McGowan, Annie Lennox, Beyonce, Carmen Maura, Taylor Swift, Lena Dunham, Katy Perry, Kelly Clarkson, Lady Gaga, and Shailene Woodley, although some have refused to self-identify as feminists. These women have been both celebrated and criticized for the positions they have taken; the term celebrity feminist is sometimes used to denigrate their credentials or question their authenticity, but there is no doubt that their championships of different causes have shed public light into myriad issues. Women Goodwill Ambassador by the United Nations, a program that actively involves prominent personalities in the fields of arts and sports to promote U.N. programs. Her role is to serve as an advocate for U.N. Womens gender equality campaign known as HeForShe. HeForShe, led by the U.N.s Elizabeth Nyamayaro and under the direction of Phumzile Mlambo-Ngcuka, is a program dedicated to improving the status of women and inviting men and boys around the world to stand in solidarity with women and girls as they make that make gender equality a reality. The speech at the United Nations was part of her official role as U.N. Women Goodwill Ambassador. Below is the  full transcript of her 13-minute speech; after that is a discussion of the speechs reception. Emma Watsons Speech at the U.N. Today we are launching a campaign called HeForShe. I am reaching out to you because we need your help. We want to end gender inequality, and to do this, we need everyone involved. This is the first campaign of its kind at the UN. We want to try to mobilize as many men and boys as possible to be advocates for change. And, we don’t just want to talk about it. We want to try and make sure that it’s tangible. I was appointed as Goodwill Ambassador for UN Women six  months ago. And, the more I spoke about feminism, the more I realized that fighting for women’s rights has too often become synonymous with man-hating. If there is one thing I know for certain, it is that this has to stop. For the record, feminism by definition is the belief that men and women should have equal rights and opportunities. It is the theory of political, economic and social equality of the sexes. I started questioning gender-based assumptions a long time ago. When I was 8, I was confused for being called bossy because I wanted to direct the plays that we would put on for our parents, but the boys were not. When at 14, I started to be sexualized by certain elements of the media. When at 15, my girlfriends started dropping out of sports teams because they didn’t want to appear muscly. When at 18, my male friends were unable to express their feelings. I decided that I was a feminist, and this seemed uncomplicated to me. But my recent research has shown me that feminism has become an unpopular word. Women are choosing not to identify as feminists. Apparently, I’m among the ranks of women whose expressions are seen as too strong, too aggressive, isolating, and anti-men. Unattractive, even. Why has the word become such an uncomfortable one? I am from Britain, and I think it is right I am paid the same as my male counterparts. I think it is right that I should be able to make decisions about my own body. I think it is right that women be involved on my behalf in the policies and decisions that will affect my life. I think it is right that socially, I am afforded the same respect as men. But sadly, I can say that there is no one country in the world where all women can expect to see these rights. No country in the world can yet say that they achieved gender equality. These rights, I consider to be human rights but I am one of the lucky ones. My life is a sheer privilege because my parents didn’t love me less because I was born a daughter. My school did not limit me because I was a girl. My mentors didn’t assume I would go less far because I might give birth to a child one day. These influencers were the gender equality ambassadors that made me who I am today. They may not know it, but they are the inadvertent feminists who are changing the world today. And we need more of those. And if you still hate the word, it is not the word that is important. It’s the idea and the ambition behind it, because not all women have received the same rights I have. In fact, statistically, very few have. In 1995, Hillary Clinton made a famous speech in Beijing about women’s rights. Sadly, many of the things that she wanted to change are still true today. But what stood out for me the most was that less than thirty percent of the audience were male. How can we effect change in the world when only half of it is invited or feel welcome to participate in the conversation? Men, I would like to take this opportunity to extend your formal invitation. Gender equality is your issue, too. Because to date, I’ve seen my father’s role as a parent being valued less by society, despite my need of his presence as a child, as much as my mother’s. I’ve seen young men suffering from mental illness, unable to ask for help for fear it would make them less of a man. In fact, in the UK, suicide is the biggest killer of men between 20 to 49, eclipsing road accidents, cancer and coronary heart disease. I’ve seen men made fragile and insecure by a distorted sense of what constitutes male success. Men don’t have the benefits of equality, either. We don’t often talk about men being imprisoned by gender stereotypes, but I can see that they are, and that when they are free, things will change for women as a natural consequence. If men don’t have to be aggressive in order to be accepted, women won’t feel compelled to be submissive. Both men and women should feel free to be sensitive. Both men and women should feel free to be strong. It is time that we all perceive gender on a spectrum, instead of two sets of opposing ideals. If we stop defining each other by what we are not, and start defining ourselves by who we are, we can all be freer, and this is what HeForShe is about. It’s about freedom. I want men to take up this mantle so that their daughters, sisters, and mothers can be free from prejudice, but also so that their sons have permission to be vulnerable and human too, reclaim those parts of themselves they abandoned, and in doing so, be a more true and complete version of themselves. You might be thinking, â€Å"Who is this Harry Potter girl, and what is she doing speaking at the UN?† And, it’s a really good question. I’ve been asking myself the same thing. All I know is that I care about this problem, and I want to make it better. And, having seen what I’ve seen, and given the chance, I feel it is my responsibility to say something. Statesman Edmund Burke said, â€Å"All that is needed for the forces of evil to triumph is for good men and women to do nothing.† In my nervousness for this speech and in my moments of doubt, I told myself firmly, â€Å"If not me, who? If not now, when?† If you have similar doubts when opportunities are presented to you, I hope those words will be helpful. Because the reality is that if we do nothing, it will take seventy-five years, or for me to be nearly 100 before women can expect to be paid the same as men for the same work. 15.5 million girls will be married in the next 16 years as children. And at current rates it won’t be until 2086 before all rural African girls will be able to receive a secondary education. If you believe in equality, you might be one of those inadvertent feminists that I spoke of earlier, and for this, I applaud you. We are struggling for a uniting word, but the good news is, we have a uniting movement. It is called HeForShe. I invite you to step forward, to be seen and to ask yourself, â€Å"If not me, who? If not now, when?† Thank you very, very much. Reception Most of the public reception for Watsons speech has been positive: The speech got a thunderous standing ovation at U.N. headquarters; Joanna Robinson writing in Vanity Fair called the speech impassioned; and Phil Plait writing in Slate called it stunning. Some positively compared Watsons speech with Hilary Clintons speech to the U.N. 20 years earlier. Other press reports have been less positive. Roxane Gay writing in The Guardian, expressed her frustration that the idea of women asking for the rights that men already have only sells when delivered in the right package: a particular kind of beauty, fame, and/or self-deprecating brand of humor. Feminism should not be something that needs a seductive marketing campaign, she said. Julia Zulwer writing in Al Jazeera wondered why the United Nations picked a foreign, distant figure to be the representative for the women of the world. Maria Jose Gà ¡mez Fuentes and colleagues argue that the HeForShe movement as expressed in Watsons speech is an innovative attempt to connect with the experiences of many women, without focusing on the trauma. However, the HeForShe movement asks for the activation of action by the people who hold power. That, say the scholars, denies the agency of women as the subjects of violence, inequality, and oppression, instead giving men the ability to restore this lack of agency, to empower the women and offer them freedom. The will to eradicate gender inequality depends on the will of the males, which is not a traditional feminist principle. The MeToo Movement However, all of this negative reaction predates the #MeToo movement, and the election of Donald Trump, as of course did Watsons speech. There are some signs that feminists of all stripes and across the world are feeling rejuvenated by the open criticism and in many cases the fall of very powerful men because they abused that power. In March of 2017, Watson met and discussed gender equality issues with bell hooks, a powerful icon of the feminist movement since the 1960s. As Alice Cornwall puts it, shared outrage can offer a powerful basis for connection and solidarity that can reach across the differences that might otherwise divide us. Parent’s Divorce Six years ago, a summer afternoon, my dad hugged me and I said â€Å"I will be gone for three days, I have a job in Austin, but I promise that I will be back before your birthday. I promise.† Days, weeks, months almost two years passed by and I did not receive any phone call or text message from him. Throughout that time my dad was gone, my mom told me that she was getting the papers ready to divorce my dad. I was noticing that the last three-four years that I was living with both of my parents, their relationship was getting worse. It was not a healthy situation for anyone in the house. What I mean about not being healthy is that my mother and father were damaging one another, emotionally and verbally, which my brothers and I would watch everything. Every day was the same routine, we forgot how it was to have a peaceful home. Around that moment, I honestly never thought divorce was going to be their solution. Going through my parent’s divorce was very life changing for me. I went through so many emotions, which until this day is a topic that is hard for me to talk about. It was very sad not seeing my parents together, having no clue where my dad was and seeing my mom sad. I would love to spend time with my parents and brothers. Crime in Urban Areas - 1686 Words

Many factors generate crime. That ‘inner morality’ necessary to resist the temptation to rape, rob, or kill weakens in an environment of broken homes, systemic poverty, ethical relativism, religious decline. Poverty ’causes’ crime in general in the same way that pornography causes sex crimes and television violence causes violence by children: it is a predispositive condition. If the family life could be strengthened, raise the living standard, instill character values this could have an impact on lowering the crime rate. In my research on crime in urban areas versus crime in the suburban areas; I predict that people who live in urban areas will have a much higher crime rate than those living in suburban areas. People living at or below poverty level feel that their chances of getting jobs and pulling themselves out of poverty has a minimal rate of success. Often times these people have less than a high school education, and this means that the only kind of job, if any, that can be secured is entry level. When the economic situation is not good, even this kind of job is hard to find. According to the FBIs final crime statistics for 2006, see chart below, violent crime is up for the second consecutive year, the first time thats happened in over 10 years. Until 2005, violent crime had steadily dropped over 15 years. The new rise in violence is gradual, not a tidal wave. However, it is still sobering for law enforcement agencies that now realize they have been overconfident. Analysis Of Kitab Tarikh Al Hind ( History Of India )

Kitab Tarikh Al-Hind (History of India), written by Al-Biruni, is an ancient text that gives scholars insight into the interactions between Muslims and Hindus during the 11th century. In this opening excerpt of the text, Al-Biruni gives an introduction to his in-depth analysis of the Hindu people from his Muslim point of view and education. In this selection, he lays out where he may encounter problems extracting the true meaning out of the Hindu people because of his bias and Muslim history. Al-Biruni’s History of India is an example of how the dual religions of Islam and Hinduism were both present in the Indian subcontinent during the 11th century, and how bias affects interpretation of other religions. The author of this excerpt, AbÃ… « Rayá ¸ ¥Ã„ n Muá ¸ ¥ammad ibn Aá ¸ ¥mad Al-BÄ «rÃ… «nÄ «, or Al-Biruni, was a scholar during the medieval Islamic era. Born in Khwarezm in 973, he was well versed in religion, history, geography, geology, science, physics, mathematics, astronomy, and natural sciences, and also distinguished himself as a historian, chronologist and linguist. Al-Biruni was alive during the Ghaznavid dynasty, which was centered in the city of Ghazni, what is now modern-day central-eastern Afghanistan. Religiously, he was considered a Shi’ite Muslim, but many times his agnostic tendencies can be seen, especially in his writing. THE PROJECT The project comprises the construction of 800 residential units each comprising of 3 bedrooms for Sale off Ojijo road on a subdivision measuring just about 100 acres. 0% to 20% of the 100 acres will be set aside for social amenities. The overall theme of the development would be one of maximizing on the plot use whilst maintaining reasonable individual privacy within a ‘Green Sustainability’ architecture. PHASED CONSTRUCTION In order to ease the impact of the overall cost of the development it is proposed to carry out the construction in phases to be jointly agreed on with the client. Each 1 acre plot will have 9 units. The construction will be phased in 10 phases comprising of 80 units respectively. Each of the phases shall be planned to deliver units that are complete and ready for occupation. This will facilitate pre-selling of some of the units prior to the end of construction. This would be achieved through pro-active networking with property managers and estates officers in large corporations and use of the internet. The foregoing will result in further cushioning of the net effect of the cost of financing the project. In order to enable planning of major infrastructural requirements such as water storage and foul water disposal right from the outset, a master plan of the entire development shall be evolved. Thus the capacity of some of the facilities may initially exceed the needs of the accommodation provided, but this would be done with the full knowledge that the development will grow to fully utilize the facilities provided. The estate is connected to the mains water supply from the Nairobi Water and also is easily connected to electricity supply from KPLC. Developments in this area are predominantly single family residences. The occupancy is predominantly homeowners. The majority of the buildings here are of high-class standard and are well constructed and maintained. MARKET DESCRIPTION Given the proximity of the site to Nairobi’s CBD, well as the good communication available along Thika road, the site would realize good returns on a single family residential development. We shall then analyze the tenders returned and forward our recommendation to the client. 5. Contract documentation With the contractors having been selected, we shall draw up the required contract documents and enter into contract with the contractors on the client’s behalf. 6. Project management Subsequent to the contracts being signed and mobilization to the site, we shall provide superintendence and project management. This will entail ensuring that the project is brought in on time and under budget by constant monitoring of operations on site and remedying any issues that may prevent timely completion or cause expenditure to exceed the budget. 7. Contract administration We shall handle all matters relating to the various contracts including but not limited to stage payments, performance bonds, extensions of time and relationships between the various trades involved in the project’s execution. 8. Sales and marketing In conjunction with an estate agency approved by the client, we have produced a presentation package to be used in the sales and marketing of the units. Early in life, he showed a great interest in mathematics and the sciences. When he was about eight years old, his father gave him a compass. Einstein wondered why it always pointed north. His uncle gave him his first mathematics book and Einstein read it until he could do every problem in the book. In school, Einstein wasnt exactly a teachers pet. Einstein more than proved them wrong. The first years on his own were the roughest for Einstein. He was unable to keep a job and wasnt credited enough for anyone to believe his theorems, yet. He married Mileva Maric in 1902 and they had their first son, Hans Albert, was born (Magill 1035). Things came together for Einstein in 1905. While working as a patent clerk, he wrote five groundbreaking articles that were published in a major scientific newsletter of the time. The first paper, titled, On A Heuristic Viewpoint Concerning the Production and Transformation of Light,; would earn him a Nobel Prize for physics in 1922. His second paper was titled, A Determination on the Sized of Molecules.; His third, On the Motion of Small Particles Suspended in a Stationary Liquid, according to the Molecular Kinetic Theory of Heat.; His fourth paper was an important one. On the Electrodynamics of Moving Bodies; was his first paper on relativity. In this paper was his special theory of relativity and the fourth dimension (time). In his last paper of 1905 he stated the ever-famous formula, E=mc2, saying that mass and energy are equivalent. These papers made him known throughout the scientific world. He was offered honorary doctorate degrees from many colleges, some of which would not even let him into their college when Einstein had applied. He taught at many different schools. He did not like it because between teaching, grading papers, and helping students (which he loved to do) he did not have the time to work on his ideas. In 1914, he took a job at the Prussian Academy of Sciences in Berlin. He was now at the top of his profession. And most important of all, he now had the time to work on more revolutionary papers. Einstein completed his general theory of relativity in 1915, after nearly ten years of work. In 1919, British astrophysicist, Arthur Eddington, photographed a solar eclipse. It revealed the light emitted from the stars was being bent as it passed close to the sun (Strathern 81). This confirmed Einste ins general theory of relativity, and he was catapulted to stardom overnight. Soon Einstein became a household name. In 1919, he divorced Mileva and married his cousin, Elsa Lowenthal. Einstein won many awards afterwards, and for the rest of his life. The facts of the case were: An oil refinery pipeline was damaged during dredging work in Sydney’s Botany Bay which connected an oil refinery at Kurnell, on the southern shore, with an oil terminal at Banksmeadow, on the northern shore * Both the refinery and the pipeline were owned by Australian Oil Refining Pty. Ltd. (A. O. R. ) and the terminal was owned by Caltex Oil (Australia) Pty. Ltd. (Caltex). * Caltex supplied crude oil to the refinery for processing, and the product was delivered to Caltex either into a vessel at the A. O. R. wharf or by way of the pipeline to the Caltex terminal. Caltex, which used but did not own the pipe, was forced to transport oil by road and sea while the line was repaired * Caltex claimed these costs from the dredge owner and the company responsible for preparing the dredging route This case succeeded in High Court on consideration of following factors: * The damages were purely economic and have resulted directly because of the defendants negligence and therefore is entitled to damages * Though there was no physical damage, defendant’s negligence has caused the plaintiff or the plaintiff’s property to be ‘immobilised’. The facts of the case are as under: * Apand Pty Ltd controls 60% of the Australian potato crisp industry and regularly new varieties of potatoes * The Perre family owns several potato farms in South Australia and sells its products in Western Australia * In 1991, Apand supplied non-certified (unapproved) potato seed for experimental use to a farm adjoining a Perre farm * The seed contained bacteria disease which infected the experimental crop * The Western Australian regulations imposed a prohibition on the importation into Western Australia, not only of potatoes grown on land known to be affected by the disease, but also of potatoes grown on land within a certain distance of affected land. Although the Perre crop was not contaminated, they were barred under Western Australian quarantine laws from selling their potatoes in that state for five years * Apand’s internal records showed it knew there was a contamination risk and that neighbouring farms could suffer economic loss because of the quarantine laws * This case was declined by the full federal court on grounds that Apand’s duty of care was limited to the farmer who had received the diseased seed However, later, on appeal to the High Court, it was held that Apand was liable * In broad terms, the court found that there is a duty to take care to avoid economic loss where: * One party knows or reasonably should know that their conduct could harm an individual or class (group) of people, i. e. , they held a ‘controlling’ position; and * That person or class cannot protect themselves, ie. they were vulnerable * However, the justices abandoned proximity as the sole basis of identifying a duty of care and took a number of individual approaches in this case with the most notable being the plaintiffs’ vulnerability and inability to protect themselves. * There were some particular policy considerations that have been identified by the courts as being relevant in these types of cases, the most often cited policy consideration in these cases is the fear of indeterminate liability’ The difference in decisions of High Court: Caltex Oil (Australia) Pty Ltd v The Dredge â€Å"Wilemstad† (1976) case was decided based on factors like duty of care, reasonable foreseeability of harm and proximity. * In Perre amp; Ors v Apand Pty Ltd (1999), factors like duty of care, plaintiff’s vulnerability and inability to protect themselves were the main considerations apart from factors of policy considerations like indeterminate liability while arriving at the conclusion not placing major reliance on proximity. Question 2 Andrew was not a regular wine drinker but to celebrate his anniversary with Mary, he decided to find the perfect red wine to complement the food that he was going to cook for both of them. Andrew was told by one of his friends that Winemaker Leo Cusseo makes excellent red wines. Andrew bought the Pinot Noir 2004 by Leo Cusseo accordingly. During the dinner, everything was very lovely and Andrew proceeded to unscrew the metal cap on the wine bottle. All of a sudden the plastic stopper on the bottle shot out and hit Andrew in one eye. This led to serious bleeding and eventually blindness on the eye. Mary was so shocked that she suffered from post-traumatic disorder and could not go back to work for months. She also had to constantly care for Andrew. After an investigation by a third party, it was later discovered that the hidden plastic stopper would often shoot out, sometimes up to 3 meters, after unscrewing the metal cap. As there was no warning on the bottle, could Andrew bring a successful negligence claim against Leo Cusseo? Explain. Issues: The Issue here is whether Andrew can bring a successful negligence claim against Leo Cusseo under common law or Statutory law? To succeed in the negligence claim, Andrew – plaintiff will have to prove these elements of law. Relevant Legal principles: We shall examine the case under both statutory law and common law. The plaintiff not only needs to prove that the defendant owed him or her a duty of care, but also that there has been a ‘breach’ of that duty of care. To prove a breach of duty involves the plaintiff having to prove two things: that he or she owed a particular ‘standard of care’ and that the defendant failed to meet that required standard or failed to take the appropriate precautions’ (Pentony at al. 2011). There is a breach of the duty of care if the defendant does not do what a reasonable person would have done in the same circumstances. To decide this, the court is to consider the following. The probability that the harm would occur if care were not taken; b) The likely seriousness of harm; ) The burden of taking precautions to avoid the risk of harm d) The social utility of the activity that creates the risk of harm (Pentony at al. 2011). 3. The third element required in any action in negligence is proof that the plaintiff suffered loss, damage or injury as result of defendant’s negligent acts or omissions. A plaintiff suffered loss, damage or injury. There are two tests which should be complied with to prove the link between the cause and damage. The ‘but for’ test and the ‘direct consequences’ test. 4. The relevant case applicable in these circumstances is Donoghue V Stevenson(1932) AC 562- common law Application: * In the present case, Leo Cusseo as a manufacturer of red wine owed a duty of care not to cause injury or damage as a result of his products. As the third party investigation revealed that the hidden bottle stopper often shooted out upto 3 metres of unscrewing the cap, it was reasonably foreseeable that Leo’s conduct could harm anyone in Andrew’s position. Moreover Leo was in a position to prevent such harm from happening as it was under his control. Moreover he failed to provide any warning about the same on the bottle of wine. Thus based on the above circumstances, it can be proved that Leo Cusseo owed a duty of care to Andrew. * To prove a negligence claim, it is important to prove that there was breach of duty of care. It can be said that there was a breach as the risk was serious, reasonably foreseeable and could be controlled. This can also be proved based on the case of Donoghue V Stevenson (1932) AC 562 where May Donoghue’s friend purchased a ginger beer contained in a dark bottle for May, and after finishing the drink, May Donoghue found the remains of a snail, she fell ill and sued for the injury caused to her. In the present case, Leo Cusseo provided defective bottle caps which harmed the plaintiff and the probability, likely seriousness of harm was high and Leo did not take any reasonable precautions to avoid this harm. * The plaintiff in the present case has suffered damage as a result of defective bottle cap which could have been avoided, had care been taken. Hence Leo was liable under common law. * Even under Wrongs Act 1958 (Vic), Leo can be held liable as the risk was foreseeable, significant and he had not taken any reasonable precaution to avoid such harm. Therefore he is liable under statutory law too. Conclusion: Based on the application of both statutory law and civil law factors, it can be held that Leo Cusseo is responsible for negligence towards Andrew. b. If there was a warning on the bottle which stated â€Å"Open carefully, inner plastic stopper may eject†, would your answer to A be different? Though there was a warning on the bottle, the tests discussed above would apply to arrive at a conclusion whether Leo Cusseo was liable under negligence to Andrew :- * Even if there was a warning on the bottle, Leo Cusseo still owed a duty of care to Andrew. It is not a mere ‘moral obligation, or social responsibility, but a legal duty of care, breach of which might result in damages†¦for any injury suffered in consequences of the breach’ * A mere warning on the bottle does not protect the defendant as they are expected to take reasonable care to prevent harm occurring to plaintiffs and the action is under control of the defendant which establishes his duty of care owed to plaintiff Andrew. * Secondly, there has been a breach of duty of care as discussed above. * Thirdly, the plaintiff has suffered damage as a result of defective bottle cap which could have been avoided, had care been taken. Hence Leo was liable under common law. Even under Wrongs Act 1958 (Vic), Leo can be held liable as the risk was foreseeable, significant and he had not taken any reasonable precaution to avoid such harm. Therefore he is liable under statutory law too. * The presence of warning on the bottle is not sufficient to refute claims of negligence by Leo. However, he can use Contributory negligence as main defence to protect himself under s 26(1) of the Wrongs Act 1958 (Vic). In order to prove contributory negligence the defendant has to prove that the plaintiff was at least partially at fault and the fault effectively contributed to the loss, damage or injury. The defendant can argue that he had provided warning and Andrew did not follow the warning contributing to his loss or injury by failing to take reasonable care. Conclusion: It can be concluded that though there is presence of warning on the bottle, it does not relieve Leo Cusseo from the duty of care he owed to Andrew. However, the same can be used as a defence in the form of contributory negligence by not following the warning. c. Can Mary bring a successful negligence claim against Leo Cusseo too? Explain. To prove negligence of Leo Cusseo towards Mary, we would need to apply the same tests of duty of care, breach of duty of care and arising of injuries or damages as a result of such breach. * Firstly, we have to establish a duty of care of Leo towards Mary. Applying ‘neighbour principle’ to determine the existence of duty of care. Though there was no contract between Mary and Leo Cusseo, According to Lord Atkin, as per the neighbour principle, the defendant must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbor. Neighbour is a person who is so closely and directly affected that they need to be in mind as being so affected that directing our mind to the acts or omissions which are called into question. * The concept of reasonable foreseeable risk of injury (and, therefore, the determination of the persons to whom a duty of care can be owed) now encompasses nervous shock or the psychiatric consequences that can result from seeing or hearing about injuries to those close to you. (Pentony et. l 2011) * Mary could bring a successful negligence claim against Leo Cusseo as evident from Jaensch V Coffey (1984) where Coffey suffered psychiatric consequences as a result of seeing and hearing about injuries to her husband. Hence duty of care of Leo can be established based on the above case. * Secondly, there has been a breach of duty of care as discussed above. * Thirdly, the Mary has suffered post-traumatic disorder as a result of seeing her husband’s accident. The display of goods on shop shelves, in catalogues and advertisements are not offers but invitations to treat. This means that if a person responds to an advertisement for goods but is not able to purchase them because, for instance, the seller has run out of stock, no remedy is available in contract. This can be proved based on the case Pharmaceutical Society of Great Britain V Boots Cash Chemists (Southern) Ltd (1953) where display of priced goods on a shelf was held not to infringe a state prohibiting the sale of drugs except under the supervision of a registered pharmacist. Similarly the display of goods in the present case was merely an invitation to treat and not an offer to sell; when Annie went into the shop, the shopkeeper could either accept or reject the offer. An invitation to treat covers all those aspects of the negotiating process falling short of the final offer. Secondly, shop keeper can argue that the advertisement was not meant to be taken seriously but was a mere advertising puff and hence there was no intention to create a legal relation.
